Right of Revocation
|The right of revocation does not apply to contracts in which the supply of goods which are not prefabricated and for whose manufacture individual choice or decision by the consumer is important or which are clearly tailored to the personal needs of the consumer.|
Custom Poker Tables GmbH, Zurich, Switzerland (hereinafter 'CPT') sells casino equipment for private and commercial use.
2. Subject of agreement
CPT sells the goods to the customer according to the General Terms and Conditions given below.
By ordering, the customer accepts the General Terms and Conditions.
3. Contract conclusion
The contract between the customer and CPT is concluded by an order from the customer and its acceptance by the CPT.
The customer's order may be by e-mail, telephone or post.
CPT accepts the order by sending the customer an order confirmation (by e-mail or by post).
We reserve the right to make changes to color, appearance and texture. Color, appearance and texture are not always identical to the images published by CPT (website, e-mails, etc.).
The purchase prices are net.
In the case of imports, VAT is levied by customs and the receiver is charged. Deliveries to EU countries are duty-free. For deliveries to Switzerland, the Customs Office collects duties. Delivery terms: DAP, Incoterms 2010.
Quotes are valid for 30 days unless otherwise indicated.
We reserve the right to change the prices.
6. Payment conditions
Bank transfer, credit card or PayPal.
Until complete payment, the ordered goods remain the property of CPT.
7. Delivery conditions
Orders are shipped via USPS Priority Mail International (Flat Rate Box Large). For larger quantities, shipping is via DHL Luftfracht Air Value. Delivery terms: DAP, Incoterms 2010.
The delivery periods and dates given by CPT are non-binding.
Delays in delivery do not qualify for compensation claims. The customer will be informed of delays in production.
8. Changing an order
After placing an order and making the payment, you can only modify the order in exceptional circumstances before the approval of the printing proof.
After the approval of the printing proof, no more changes can be made.
9. Cancelling an order
After placing an order and making the payment, you can only cancel the order in exceptional circumstances before the approval of the printing proof.
After the approval of the printing proof, you can no longer cancel the order and the payment will not be refunded.
10. Warranty claims
CPT is to be notified of any deficiencies in writing within 5 days of the customer receiving the goods.
If the goods delivered by CPT are faulty, the customer's warranty claim complies with the legal specifications, provided that the customer can only request rectification.
CPT is obligated to bear the costs of supplementary services, as long as these are not increased by the goods having been taken to another location to the place of delivery.
If the shortage is due to an erroneous third party product, CPT is entitled to cede the warranty claims against the preliminary supplier to the customer. In this case, a claim can be filed against CPT for the terms above, if the customer has made the assigned claims against the preliminary supplier legally enforceable.
There is no right of return.
CPT assumes no liability for potential damages or consequential damages that occur during use or handling of the purchased goods because proper operation or handling cannot be controlled or monitored by CPT.
Claims for damages against CPT cannot be enforced.
For legal reasons, the goods must not be used for illegal gambling.
CPT has the right to make images and movies of the sold goods and use and publish these on all media (on- and offline) for communications and marketing purposes.
13. Final provisions
Swiss law applies to these terms and conditions as well as the business relationship between CPT and the customer. International sales law is excluded.
The validity of individual provisions in these terms and conditions does not affect the validity of the other provisions and the contract's existence. In place of the ineffective provision is a rule that contains the most similar economic content possible. The same applies in the case of omission.
The place of execution for all claims arising from contracts with CPT is the CPT headquarters. The jurisdiction for all mutual claims arising from or in connection with the business relationship is Zurich, Switzerland. CPT may also sue the customer at their offices.
CPT is entitled to change the General Terms and Conditions at any time. The General Terms and Conditions published on the website are valid.
